Personal Illustration Terms of Service
Paying for a commission acknowledges that you have read and agreed to the following Terms of Service.
1. In order to commission me, we must be communicating through either email (wingednyke@gmail.com) or the platform upon which the initial contact was made.

2. I must receive all reference images and/or text descriptions before I begin any work.

Character sheets, images done by other artists, text descriptions and animal/object/clothing references from Google are fine with me. If these are not given, I will have to guess. If something is necessary, tell me. I am not responsible for changing things on a commission later due to the client's oversight on a detail. Small alterations will be made; I will be communicating with you as the commission progresses
PLEASE USE CORRECT REFERENCE - If your refs have a discrepancy, please let me know which is the MOST correct! Please do not send me a 12 paragraph RP description: simplify it down to the bare bones. Please attach rather than link references if possible, as websites are not always reliable! If you link a reference and I cannot access it, I will put off working on your art until I can access it.

3. I send progress images for digital work in the following steps: sketch, preliminary ink, flat colors, final. I allow 3 fixes per commission.

My sketches are pretty loose, usually on paper.
After an approval on the inks, I will no longer adjust the base drawing.
The flats show the colors I've picked (I do not use an eyedropper).
The last stage is after all the shading and details
If all of this is to the clients satisfaction, I send off a full rez copy, and a resized copy suitable for online use.
Any fixes beyond the base 3 are subject to a 10$+ charge depending on complexity.

4. I reserve the right to use any image I create as I see fit. I retain all rights to the image.

This includes, but is not limited to, producing and selling prints or portfolios (print, digital or CD) and/or posting to my online galleries. I retain full commercial and distribution rights on any image I produce.
If the client does not wish to pay shipping for traditional art (including sketches), I reserve the right to sell originals at conventions or online auction.
The client may use the commission image at any size as they please FOR PERSONAL USE ONLY. Personal use excludes any and all commercial purposes (logos, SecondLife mag use, selling their own prints). No profit is to be made off the image. If posted online, I require being listed as the creator and I would prefer a link back to this gallery. Alterations to the image are NOT ALLOWED without my written consent. I am open to commercial usage rights purchase, but this is on a case by case basis and pricing starts at over 300$ USD on top of the normal charges. Please contact me for details.
I will never dishonor a client's personal character in my redistribution, and my usage rights are not up for discussion. If my usage rights are not to your satisfaction, my pricing for giving up rights starts at 300$.

5. I use U.S. Dollars as my currency and accept payment through Paypal; you will receive an invoice.

I will invoice clients after the quote is finalized with the agreed upon price.
NOTE: I know that marking a payment as a "gift" makes it fee-free, but please don't ever use this in your dealings with artists. PayPal is known for freezing and banning accounts that misuse their service. This also protects you the client as it creates a papertrail for the transaction.

6. I reserve the right to terminate a commission at any time I see fit, or refuse work from any person at any time.

I reserve the right to cancel and/or refund a commission at any time due to poor communication, rude or inappropriate behavior or the inability to communicate in a way we can both understand. I have only had to refund a few in my history of working online, out of hundreds of transactions.
If a refund needs to happen, I will refund the remaining balance of the commission less work and materials, depending on the situation. Depending on the circumstances, the commissioner may or may not receive the completed work and may or may not retain any usage rights whatsoever.
There are NO refunds on completed work.

7. It is the responsibility of the purchaser, or person who contacted me, to distribute the works in progress to other participants in group commissions.

I recommend that the client does this BEFORE responding that everything is approved in the current step. If my Point of Contact fails to do so, I am not responsible for any miscommunication between the other parties.

8. If I do not receive communication back from a client for over a year, their commission and funds are forfeited and no commission will be delivered.

I make 3 attempts at communication over this time. If I receive nothing back, I am absolved from the work and the client may not request a refund.
​
​
9. I do not draw the following subjects in adult scenarios: minors or feral, non-sentient creatures.
​
10. I work in my own style and my style alone.
​
I expect that my clients have chosen my art because they enjoy it for what it is. I do not adjust my style for commissions.
